4.4.    Data are retained for as long as the subscription to the service lasts. Upon contract expiration the data will be deleted or returned to the customer if the customer instructs us to.

11.    You agree to indemnify The Big Canvas and its Related Parties in respect of any liability incurred by The Big Canvas for any loss, claim, damage (including all reasonable legal fees), howsoever caused, and suffered by The Big Canvas or its Related Parties due to, or arising out of, your breach of these Terms, your User Content or your use of the Website, including but not limited to, any breach of IP rights in connection with the Website or your User Content.

12.    These Terms are effective unless and until terminated by either you or Us. Your sole recourse if you wish to terminate these Terms is to cease using the Website.

13.    Any failure by The Big Canvas to exercise or enforce any right or provision in relation to these Terms does not constitute a waiver of such right or provision.

14.    These Terms are governed by and construed in accordance with the laws of Victoria, Australia and both parties agree to the exclusive jurisdiction of the courts of Victoria
